That's correct. Not only the software developers, but also the purchasers of software are the victims here, because all licenses purchased from Digital River are legally void. The seller was not permitted to sell them after July 24 due to contract breach. They should reclaim their payments, if they haven't yet done so.

We have established a new license server independent from DR, so licenses will not automatically expire.

Delay in insolvency is a fraud crime in Europe, especially under those circumstances. This can get the CEO into prison. Since the CEO of DR is an US citizen, he is probably safe as long as he remains in the US, and stays away from Europe. I don't know whether he will be persecuted by US law.

Digital River MyCommerce said in January 2025 that it plans to declare bankruptcy, but it has been trading while insolvent since July 2024.

Anyone who has bought software through Digital River MyCommerce since July 1, 2024 should report the transaction as fraudulent and claim the payment back from their credit card or PayPal. It was fraud because DR was trading while insolvent since July and never remitted the payment (less the DR commission) to the original software vendor.

When you receive your refund you should then re-visit the software vendor's website and purchase again. The vendor will now have switched to an honest ecommerce gateway so they will get the payment for your new license as intended.
